    Product Agreement

    By registering to this web site, you agree that you will use Giveffect Inc products under the terms of this Product Agreement ("Agreement",). As used in this Agreement, the term “Product” refers to Giveffect Inc’s software products, Giveffect platform, and its content and its documentation. The term "Giveffect Inc" or "us" or "we" refers to the owner of Giveffect Inc whose registered office is 1178 Broadway, 3rd Floor #1144, New York, NY 10001, USA. The terms "user" or "you" refers to the user or viewer of the website.

    By registering to this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together, with our privacy policy, govern Giveffect Inc’s relationship with you in relation to the Product.

    Neither we nor third parties provide any warranty or guarantee as to the accuracy, performance, completeness or suitability of the information (except for this Agreement and the Giveffect Inc Privacy Policy) and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your responsibility to ensure that any products, services or information available through this website meet your specific requirements.

    This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout look, appearance and graphics. Reproduction is prohibited other than in accordance with copyright notice, which forms part of these terms and conditions.

    You agree that the contents of all oral and written reports to us and any other materials, information, ideas, concepts, and know-how relative to Giveffect Inc’s products or website provided by you (including suggestions and corrections to the problems in the Product and documentation) become the property of Giveffect Inc, which you hereby assign to Giveffect Inc, and may be used by Giveffect Inc for all business purposes, without any payment to you. Under no circumstance will Giveffect Inc become liable for any payment to you for information you provide, whether concerning the Product or otherwise, n matter how such information is exploited by Giveffect Inc or anyone else.

    If you are a charitable group client, you will retain ownership of any content that you upload to the website for use with Giveffect Inc’s products as part of your philanthropy activities. Giveffect Inc will not sell, share, disclose, make available (except to your users/donors, as intended by you) or otherwise use said content without your express written consent. Giveffect Inc will not retain copies of said content in any form or medium after you remove it from the website.

    You agree you will not reproduce, duplicate, copy, sell, trade or resell any components of the website for any purpose.

    Unauthorized use of this website may give rise to claim for damages and/or be criminal offense.

    You agree to use the data in accordance with the Giveffect Inc Privacy Policy.

    Privacy Policy

    This section describes how we treat personal information when you use Giveffect Inc’s website and Giveffect Inc’s services, including information provided when you use the website.

    When you signup to use Giveffect Inc, we ask for some personal information to register your account. We will not use your information for any purposes other than to communicate directly related to your use of the Product, and we will not share your email with third parties.

    Our servers automatically record information about your use of the service, such as when you log in and make a donation to a charitable group. We will associate this information with your account. The clients/charities of Giveffect Inc may use those data for analytics purposes. We store and maintain you account information in order to provide the service.

    Giveffect Inc may conduct statistical analysis to study the effectiveness of our system and to increase client and user experience. No identification of users will be revealed at any point to any third party not already outlined in this agreement.

    We do not sell, rent, trade or otherwise disclose personal and associated information about our website users.

    We use administrative, technical and physical safeguards to protect information in our possession and control against foreseeable hazards. The servers on which user data are stored are located in a secure facility. Please note, however, that perfect security does not exist on the internet.

    1. State your organizations purpose and focus.

      Tell everyone what your organization is about.Describe what your organization is trying to do and how your organization is doing it.

    2. Optionally provide a YouTube or Vimeo URL to a video that describes your organization.

    Create an administrator account.

    Specify a login Email and Password to access the backend tools.

    1. This will be the primary login email for the account. It may differ from the organization's contact email address. Secondary Administrator Accounts may be created after registration.

    Specify the causes that best fit your organization from the list below.

    These categories help our donor community find and support charities within these areas. New categories may be added upon request once registered.

    What should I expect during the 14-Day Free Trial?

    Let us take care of your nonprofit software. Your trial comes pre-loaded with mock data, a branded experience - and more! All plans include unlimited events and fundraising pages - start a 5 day fundraising campaign to experience the Giveffect software. Not so tech savvy? Don't worry, we have instructions, video tutorials and built-in chat support to guide you along the way. Once you sign up our Vetting Team will verify your credentials and you'll receive an email with login instructions within 24 hours.

    Why do I have to wait?

    It's simple. You wouldn't want another person claiming to be your organization and accepting donations on your behalf, now would you? This is why we have a verification process to confirm your identity, EIN, nonprofit status, and credentials. This typically takes less than 24-hours.

    When does the billing cycle start?

    If your nonprofit decides to move forward with Giveffect, you'll be able to select a plan and enter your credit card details after the 14-Day Trial ends. This is a month-to-month or annual subscription plan, with minimum one year contract.

    How do I select a pricing plan or cancel the trial?

    When you login to the Giveffect nonprofit software, under Charity Settings in Pricing Plan, you may select a pricing plan or cancel your trial.

    Terms and Policy

    This agreement sets out the terms on which Giveffect Inc. (“Giveffect”) makes the Giveffect Inc system (the “System”) available to your organization.

    Giveffect agrees to the following terms:

    • License. Giveffect hereby grants you a non-exclusive, non-assignable, royalty-free license to use the System for the purposes of your organizational philanthropy efforts.
    • Support. Giveffect agrees to supply ongoing service and support to you throughout the duration of our agreement.
    • Training. Giveffect will conduct product training at no charge to your organization.

    You agree to the following terms:

    • Use. In consideration of the rights we are granting, you agree that you will use your best endeavors to use the System for your organizational philanthropy efforts. You agree that you have provided us with an accurate organization registered charitable number and that you will notify us, should your organization’s registered status change (provincially and/or nationally).
    • Training. In preparation for using Giveffect platform/website, you may participate in a free 1 hour training session to ensure appropriate usage of the website.
    • Intellectual Property. Giveffect and its licensors own all rights, title and interest, including all related Intellectual Property Rights, in and to the System. Giveffect retains all IP rights of simulations and content that they build and add to the system. This Agreement is not a sale and does not convey to you any rights of ownership in or related to the System, the underlying technology or the Intellectual Property Rights therein.
    • Cost. The use of Giveffect is depends on the plan selected. Please refer to plan pricing in the previous page.

    Term

    This Agreement shall be effective commencing Jan. 20, 2015, and shall continue until terminated. The terms of this agreement remain in force should the system be used for subsequent instances of the course.

    No Warranties

    To the maximum extent permitted by applicable law, the system is provided to you ‘as is’. Giveffect makes no representations, warranties or conditions, express or implied, written or oral, including, but not limited to, warranties of merchantable quality, satisfactory quality, merchantability, fitness for a particular purpose, non-infringement or title, or those arising by law, statute, usage of trade, course of dealing or otherwise. Giveffect does not represent or warrant that the system will always be available, accessible, uninterrupted, timely, secure, accurate, complete and error-free or that it will operate without packet loss, nor does Giveffect warrant any connection to or transmission from the internet.

    Limitation of Liability

    Accordingly, you acknowledge and agree that, to the maximum extent permitted by applicable law, Giveffect shall have no liability in connection with or arising from your use of the system for any reason and upon any cause of action whatsoever, whether in contract, warranty or tort, even if the damages are caused by breach of contract or by negligence, gross negligence, misrepresentation or other fault in connection with this agreement.

    General

    This Agreement sets forth the entire and complete and exclusive agreement and understanding between the Parties. The terms of this Agreement can be changed by an amendment authorized by each Party. This Agreement is governed by the laws of the state of California, USA.
